By accessing this website, we assume you accept these terms and conditions in full. By using the services provided by Haghzare & Co., the individual acknowledges that they have read, understood, and agree to be bound by the Terms and Conditions outlined herein ("Agreement"). User further acknowledges that these Terms and Conditions constitute a legally binding agreement between User and Haghzare & Co.

Terms and Conditions 

 

These Terms and Conditions govern the contractual relationship between the Service Provider and its User more specifically defined herein below:

Service Provider and Client shall individually be referred to as a “Party” and collectively as “Parties”. The term Service Provider and Client shall include its Affiliates and/or representative, wherever the context requires or permits, in this Agreement.

All terms refer to the offer, acceptance, and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of the provision of the Company’s stated services, in accordance with and subject to, prevailing law.

Haghzare & Co. reserves the right to modify these terms and conditions at any time without prior notice. Changes will be effective immediately upon posting on the website.

 

WHEREAS

1. Service Provider  is the registered Company 'Silicon Valley Associates Recruitment - FZCO' in Dubai Integrated Economic Zone (DIEZ) operating from Dubai Silicon Oasis (DSO) registered with licence number 23732 and carries out the activity related to Human Resources Consultancies under the brand name of 'Haghzare & Co';

 

2. Client is an individual, actively seeking a job placement in the United Arab Emirates.

 

3. Client has expressed his interest and Service Provider has shown their calibre to assist the Client to provide services more specifically defined in this term and conditions with respect to Client profile;

 

4. Based on mutual covenants Parties has accepted each other proposal to enter into this Agreement.

 

NOWTHEREFORE, in consideration of the covenants and agreements set forth herein and the for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties hereby agrees as follows in connection with provisions of services under this Agreement: -

 

1. Scope of Services

Haghzare & Co. provides professional services to candidates seeking employment in Dubai. Our services include but are not limited to job search assistance, resume writing, interview preparation, and career counseling.Candidates are required to pay for our services before we initiate the process of finding a job for them.

Service Provider agrees to provide the Client, a suitable job placement, subject to obligations and covenants as contained in this agreement, that will include the following services: -

 

  1. Self-Assessment: Before beginning the job search, it's essential to assess skills, strengths, weaknesses, preferences, and career goals. Service Provider will help the Client in targeting suitable opportunities and crafting effective application materials.

  2. Researching Opportunities: This involves identifying potential employers, industries, and positions that align with one's skills, interests, and career objectives. Service Provider may include exploring job boards, company websites, professional networks, and industry publications.

  3. Networking: Building and leveraging professional networks can significantly enhance job search prospects. Service Provider may help the Client in networking which involves reaching out to contacts, attending industry events, joining professional organizations, and utilizing online networking platforms like LinkedIn, at the cost of the Client.

  4. Resume/CV Preparation: Service Provider will help the Client in crafting a well-written and tailored resume or curriculum vitae (CV) is crucial for making a positive impression on potential employers. Service Provider will guide the Client to highlight relevant skills, achievements, and experiences that match the requirements of the desired positions.

  5. Cover Letter Writing: Service Provider will if necccessary assist the Client to draft a customizing cover letter to specific job applications which will help in demonstrating interest and suitability for the role to ensure that it should effectively communicate the Client qualifications, motivations, and fit for the position and organization.

  6. Application Submission: Service Provider on behalf of the Client, will apply for job openings involves submitting resumes, cover letters, and other required documents through various channels, such as online job portals, email, or direct mail and the Client undertake to follow application instructions and deadlines which is an essential part of the whole process.

  7. Interview Preparation: Preparation is key to performing well in job interviews. This includes researching the company, practicing responses to common interview questions, and preparing questions to ask the interviewer. Mock interviews can also be beneficial.

 

2. Term and Termination

 

  1. This Agreement shall commence on the effective date of singing and shall remain in force until the period of 1 month from thereof or until the completion of the agreed upon Scope of Services whichever is earlier.

  2. Either Party may terminate this Agreement by providing written notice to the other Party if there is any material breach. This Agreement cannot be terminated for convenience.

  3. Upon termination – the Service Provider shall promptly cease all ongoing services and deliverables related to the Scope of Services. The Client shall pay any outstanding fees owned to the Service Provider, if there is any due, for the services already rendered up to the date of termination. Any confidential information exchanged between the Parties shall continue to the subject to the confidentiality provisions of this Agreement.

  4. The provisions of this Agreement that by their nature would logically continue beyond termination, including but not limited to confidentiality obligations, payment obligations, and dispute resolution provisions, shall survive termination.

  5. Neither Party shall be liable to the other for any damages, losses, or expenses arising from the termination of this Agreement, except as expressly provided herein.

 

3. Fees & Payment

 

Clients must make payment for our services as outlined on our website or as agreed upon with our representatives. Payments are non-refundable unless explicitly stated otherwise. All payment transactions are processed securely.

  1. Client Agrees to pay Service Provider 2000 AED to the designated account of the Service Provider before the date of execution of this Agreement. All fees are upfront only.

  2. Fees is essence of this Agreement and the services will start only on receipt of fees as per above.

  3. The Client shall be responsible for any applicable taxes, duties, or levies imposed on the services provided under this Agreement.

  4. Payment once made cannot be refunded unless otherwise the contract is terminated at the option of the Service Provider.

  5. Services under this Agreement is not definite but on conditions more specifically defined herein in this Agreement. Fees once paid will not be refunded under any circumstances unless otherwise defined in this Agreement.

 

4. Obligations


Clients are responsible for providing accurate and up-to-date information to Haghzare & Co. for the purpose of job search assistance. Clients must actively participate in the job search process and follow any instructions provided by Haghzare & Co. to increase their chances of finding employment.

  1. Clients Obligations –

  • Commitment to Diligent Search: The Client acknowledges the importance of conducting a diligent and proactive job search. This includes regularly seeking out job opportunities, networking with industry professionals, and utilizing available resources to maximize job search effectiveness;

  • Accuracy of Information: The Client agrees to provide accurate and up-to-date information regarding qualifications, skills, work experience, and career objectives to Service Provider and potential employers and to other job search assistance providers as introduced by the Service Provider;

  • Professional Communication: The Client commits to maintaining professional communication at all times, including in written correspondence, phone calls, interviews, and networking interactions. This includes prompt responses to inquiries and adherence to established communication protocols

  • Adherence to Application Procedures: The Client agrees to carefully review and follow the application procedures outlined by each prospective employer. This includes submitting required documents (e.g., resumes, cover letters, application forms) within specified deadlines and in the prescribed format.

  • Preparation for Interviews: The Client acknowledges the importance of adequately preparing for job interviews. This includes researching the prospective employer, practicing interview questions, and presenting oneself in a manner consistent with professional standards.

  • Ethical Conduct: The Client pledges to their conduct in an ethical manner, refraining from any deceptive or misleading practices that may compromise their integrity or the integrity of the job search process.

  • Continuous Improvement: The Client recognizes that the job search process may involve challenges and setbacks. However, the Seeker commits to embracing opportunities for learning and growth, continuously refining their job search strategies and presentation skills to enhance their competitiveness in the job market.

  • Respect for Others: The Client agrees to treat all individuals encountered during the job search process with respect and professionalism, including employers, recruiters, networking contacts, and job search assistance providers.

 

Haghzare & Co. endeavors to assist Clients in finding suitable employment opportunities in Dubai and the United Arab Emirates. While we strive to find suitable job placements for all Clients, the Service Provider does not guarantee job placement or employment success. Clients understand and acknowledge that the job market is competitive and the availability of suitable job opportunities may vary.

     2. Service Provider (Provider) Obligations –

  • Initial Consultation: The Service should conduct an initial consultation with the Client to understand their career goals, skills, experience, and job preferences. This helps in tailoring the job search services to meet the client's specific needs.

  • Resume/CV Writing and Optimization: The Service Provider is responsible for advising or optimizing the client's resume or curriculum vitae (CV) to highlight their skills, achievements, and experiences in a manner that is relevant to the desired job positions.

  • Cover Letter Drafting: The Service Provider should assist if neccessary the Client in drafting customized cover letters tailored to each job application, showcasing the client's qualifications and interest in the position. 

  • Job Search Strategy Development: Based on the Client's career objectives and preferences, the Provider should develop a comprehensive job search strategy, including identifying suitable job opportunities, networking tactics, and application methods. 

  • Identifying Job Opportunities: The Service Provider is tasked with researching and identifying relevant job opportunities that align with the Client's skills, experience, and career goals. This may involve searching job boards, company websites, and other sources. 

  • Application Assistance: The Service Provider should assist the client in preparing and submitting job applications, including reviewing application materials, ensuring completeness and accuracy, and adhering to application deadlines. 

  • Interview Preparation: The Service Provider should offer guidance and support to the client in preparing for job interviews, including conducting mock interviews, providing feedback, and offering tips on interview techniques. 

  • Follow-Up Support: After job applications or interviews, the Service Provider should provide follow-up support to the Client, including advice on post-interview etiquette, responding to job offers, negotiating salary, and handling any other related matters. 

  • Continuous Communication: The Service Provider should maintain open and regular communication with the Client throughout the job search process, providing updates, feedback, and support as needed. 

  • Confidentiality: The Service Provider should maintain the confidentiality of the Client's personal information, job search activities, and any other sensitive data shared during the course of the engagement. 

  • Professional Conduct: The Service Provider should conduct themselves in a professional manner at all times, adhering to ethical standards and best practices in the field of career services.

 

5, CONFIDENTIALITY AND NON-SOLICITATION

 

Haghzare & Co. respects the confidentiality of Client information and will only use it for the purpose of providing services as outlined in these terms and conditions. Client information will not be disclosed to third parties without the Client's consent unless required by law.

  1. The Parties shall keep the subject matter and terms of this Agreement, and all documents and information shared during the subsistence of this Agreement, strictly confidential and shall not disclose the contents of it to any third party, save for the employees, agents, consultants and legal and financial advisors to each of the Parties, on a need-to-know basis and subject to any obligation of confidentiality of their part on similar terms.

 

   2. The obligations of confidentiality shall not apply to any information that:

  • was known to the Party prior to its disclosure by the disclosing Party without any obligation of confidentiality;

  • has become generally available to the public (other than due to the disclosure by the receiving Party);

  • may be required in any report, statement or testimony submitted to any governmental regulatory body; and

  • may be required in response to any summons or subpoena or in connection with any litigation.

  • may be required to comply with any law, order, regulation or ruling applicable to any Party hereto

     

       3. Client further undertakes not to approach or solicit, either directly or indirectly, any of the clients as introduced to Service Provider during the term of this Agreement for a period of 2 years post the termination and / or cessation of this Agreement.

6. Governing Law 

These terms and conditions are governed by and construed in accordance with the laws of ?, and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

By using our website and services, you hereby consent to our terms and conditions and agree to abide by them. If you have any questions or concerns regarding these terms and conditions, please contact us.

1. Any and all disputes or differences between the Parties arising out of or in connection with this Agreement or its performance or the rights, duties or obligations of the Parties hereunder shall (the ‘Disputes”), so far as it is possible, be settled amicably through consultation between the parties

2. If after fifteen (15) Business Days of consultation, the Parties have failed to reach an amicable settlement, on any or all Disputes, such Disputes or differences shall be submitted to final and binding arbitration at the request of any of the Parties upon written notice to that effect to the other.

3. The arbitration proceedings shall be conducted in Dubai, in accordance with Arbitration Laws in DIFC, Dubai, United Arab Emirates, as amended from time to time. No award of punitive damages may be rendered by the arbitrator in such proceeding. All proceedings of such arbitration shall be in the English language.

4,  Any arbitration hereof shall be conducted in accordance with the following procedures:

The Party (the “Requesting Party”) demanding arbitration hereunder shall give a written notice of such arbitration demand (“Arbitration Notice”) to the other Parties (the “Responding Party”) which Arbitration Notice shall describe in reasonable detail the nature of the Dispute and any relief or remedy sought.

6. Unless the parties agree for a single arbitrator to be appointed mutually, the arbitration shall be conducted by one (1) arbitrator.

7. The presentations of the Requesting Party and the Responding Parties in the arbitration proceeding shall be commenced and completed within ninety (90) days after the selection of the arbitrators pursuant to above, and the arbitrators shall render their decision in writing within thirty (30) days after the completion of such presentations.

8. All dispute shall be subject to law in UAE and shall have final jurisdiction to resolve disputes.

 

7. Miscellaneous Provisions: -

 

To the extent permitted by law, Haghzare & Co. shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services.

  1. If any provision of this Agreement or any one or more of the phrases, sentences, clauses or paragraphs contained herein is determined to be invalid, illegal, void or voidable by any order, decree or judgment of any court, this Agreement shall be construed as if such phrases, sentences, clauses or paragraphs had not been inserted in this Agreement

  2. Once this Agreement is executed, all other written or unwritten understanding and documents between the Parties will nullify and this Agreement will supersede all prior agreement and understanding.

  3. The terms or provisions of this Agreement may be modified, amended, supplemented, waived, or discharged only in writing and which may be in the nature of an addendum, agreement, etc, and which will be signed by both the Parties hereto.

  4. Neither Party shall assign any of its rights or obligations under this Agreement to any third party without the prior written consent of the other Party.

  5. Notwithstanding the termination or expiry of this Agreement, the provisions concerning obligations of Parties, including, termination, governing law and jurisdiction, survival, indemnifications, confidentiality, protection of intellectual property rights, notice, etc. shall survive up-to five (5) years from the date of termination or expiry of this Agreement.

  6. All notices and other communications required or permitted to be given under this Agreement shall be in writing and shall be delivered or sent by personal delivery, electronic mail, facsimile transmission or registered or courier or certified mail (return receipt requested) postage prepaid to the relevant Party at the address as mentioned hereinabove or facsimile number(s), or such as have been notified in writing by such Party to the other no less than 15 days in advance.  The notices and communications sent in such manner shall, unless the contrary is proven, be deemed to have been duly received on the date of personal delivery, two business days following delivery, upon confirmation of transmission by the sender’s facsimile machine or electronic mail device or ten business days following mailing by registered or certified mail return receipt requested postage prepaid.

  7. Nothing in this Agreement (or any of the arrangements contemplated herein) shall be deemed to constitute a partnership between the Parties, nor, except as may be expressly provided herein, constitute any Party as the agent of another Party for any purpose, or entitle any Party to commit or bind another Party in any manner.
